Terms of Service

"Company" means OPSoft Inc (30 N Gould St, Ste R, Sheridan, WY 82801, USA), which owns and operates betafinds.com (the "Site" or "Platform").

"User" means anyone using the Site. "Account" means a User's account. "Content" means any materials a User posts: startup descriptions and logos, screenshots, links, release files, comments, and votes.

By using the Site, registering, or posting Content, you fully and unconditionally accept these Terms and the Privacy Policy. If you do not agree, do not use the Site.

By using the Site, you confirm that you have the legal capacity to enter into these Terms.

Some features (submitting startups, update and release feeds, commenting, voting, subscriptions) require registration. You agree to provide accurate information and keep it up to date.

You are responsible for keeping your Account secure and for all activity under it.

By posting Content, you warrant that you hold all necessary rights to it (including rights to text, images, logos, video, and files) and that it does not infringe third-party rights or applicable law.

Content posted on the Site is public: it may be viewed by anyone, including through search engines, and used by the Company to generate preview images for search results and social networks.

By posting Content you grant the Company a non-exclusive, royalty-free license to use it for operating the Site (storage, display, caching, and preview generation) for as long as the Content is posted.

Startups are published after moderation. The Company may reschedule publication, request changes, or decline a submission without stating a reason.

By uploading release files (installers for Windows, macOS, Android, etc.) distributed via downloads.betafinds.com, you further warrant that you have the right to distribute them and that they contain no malware. The User who uploads a file is responsible for it.

Separate rules for submitting startups and the license you grant are set out in the Submission Terms, accepted when you submit a startup.

The Company offers paid promotional placements ("Featured") that pin a startup to the featured spot on the Site and mark it with a "Featured" badge for a fixed period. Featured placements are available for approved startups on betafinds.com.

Featured placements are advertising. They do not influence moderation decisions and do not guarantee any specific number of views, votes, clicks, sign-ups, or other results. The Company retains full editorial and curatorial discretion over how and where Featured items are displayed.

A Featured period runs for the purchased number of days from the moment the placement goes live. A placement applies to a single startup and is non-transferable.

Featured placements are sold as one-time purchases for a fixed number of days, at the prices shown on the promotion page. Prices are in US dollars and exclude any taxes that may apply at checkout.

Paddle.com Market Ltd acts as the merchant of record for all paid transactions. Payments are handled by Paddle, and charges appear as "Paddle" on your statement.

You may request a full refund within 14 days of purchase, provided your Featured placement has not yet started appearing on the Site. Once the placement has gone live, the purchase is non-refundable, as the advertising service has then been delivered. See our Refund Policy for details.

You may not post material that violates applicable law, including extremist content, promotion of violence or drugs, or pornography; distribute spam, malicious links, or misleading information; or engage in phishing or other fraud.

You may not impersonate another person or an organization without authority, or manipulate votes, ratings, or statistics.

Automated data collection (parsing, scraping), bulk export, and circumvention of technical limits outside the Platform's official API are prohibited. Use of the Platform's official API in accordance with its documentation is permitted.

The Site's design, code, database, and layout belong to the Company and are protected by law. Any commercial use of them (copying the catalog, republishing cards, aggregating the database) without the Company's written permission is prohibited.

The Company may remove or hide Content that violates these Terms without prior notice, and may suspend an Account or terminate these Terms if a User violates the Terms or applicable law.

The Site is provided "as is". The Company does not review all user materials before publication, does not guarantee their accuracy, and does not guarantee uninterrupted or error-free operation. The Company is not liable for any direct or indirect damages arising from use of or inability to use the Site.

If third parties bring claims against the Company caused by a User's violations, that User agrees to resolve such claims at their own expense.

The Company may update these Terms. Unless stated otherwise, changes take effect when the updated version is published on this page. Continued use of the Site constitutes acceptance of the updated Terms.

You may delete your Account through the Site or by request to admin@betafinds.com. After deletion, associated Content is deleted or anonymized within a reasonable time, except where retention is required by law, needed to handle claims or disputes, or technically present in backups.

Public materials already indexed by search engines or republished by third parties may persist outside the Site beyond the Company's control.

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws rules. The parties will attempt to resolve disputes through good-faith negotiation before pursuing other remedies.
